Setting up a business and self-employment

If you are a national of an EU member state, you do not need a residence permit to set up a company. Citizens of non-EU countries can apply for a residence permit to pursue a self-employed activity. This application must generally be submitted to the relevant German consular office abroad. If you are already in Germany with another form of leave to remain, you can apply to the relevant Immigration Office (Ausländerbehörde) for authorisation to pursue a self-employed activity.

If you wish to start a business, you need both a business idea and a detailed concept of how you intend to realise this business idea. You should draw up a detailed business plan covering all the essential points of your company formation, along with all opportunities and risks.

Essential features of a business plan include:

  • The business idea
  • ­A profile of the company founder(s)  
  • ­An assessment of the market, location and competition
  • ­A marketing strategy
  • ­Organisation and staffing plans
  • ­Plans covering the premises and technical features
  • ­Capital requirements and financial plans, etc.
